Best LLC for streamers: payouts, donations and withholding

Streaming income arrives from four or five directions at once — subscriptions, bits, donations, sponsorship, ads — and creators routinely assume at least one of them is not taxable. All of them are.

The short answer

A single-member LLC once income is consistent. Complete the platform tax interview properly first if you are outside the US; that decides more of your take-home than the entity does.

Streaming is the creator model with the most fragmented income and the least paperwork attached to any single payment. That combination produces a specific problem: nobody sends you a tidy statement, and the tax authority does not accept that as a reason.

The short answer

A single-member LLC once income is consistent enough to plan around. Model the S-corp election at roughly $90,000 of profit, weighting durability heavily — streaming income can halve when a game cycle ends or an algorithm changes.

The tax interview decides your payout

Platforms collect tax information before paying you, and for creators outside the United States the US-source portion of certain income can be withheld at source. Submitting a valid treaty claim through the platform's onboarding is what reduces the rate — and skipping it means the highest default applies quietly, forever, until you fix it.

Playing recorded music on stream generally requires permission you do not have, and platforms respond to rights-holder notices with muting, takedowns and strikes. The specific problem for streamers is that VODs and clips persist: a track played live for four minutes becomes a permanent artefact that automated systems will find months later.

  • Use a licensed stream-safe library. They exist precisely for this and cost very little.
  • Clear your VOD library if you have historic content with music in it.
  • Game audio is usually covered by the publisher's own terms, but licensed soundtracks inside games sometimes are not.
  • Strikes accumulate against the channel, which is the asset you have spent years building.

What the entity is actually for

Not tax — a disregarded LLC changes nothing there. It is for contracting with sponsors as a business, separating channel money from personal money so deductions are defensible, and providing some liability separation for a business conducted live in front of an audience. It does not protect the channel itself, which remains subject to the platform's terms.

  • Complete the platform tax interview with a treaty claim. This is the highest-value action on this page.
  • No S-corp election — Section 1361 bars non-resident alien shareholders.
  • Form 5472 with a pro-forma Form 1120 annually for a foreign-owned single-member LLC, $25,000 penalty for failure to file.
  • A US LLC does not stop withholding, because a disregarded entity is transparent — the analysis still runs to you.
