Trademark holding and Amazon Brand Registry: who should own the mark

Brand Registry is the mechanism that gives a seller control over their own listings — content that sticks, enhanced product pages, and a workable process for removing hijackers. It requires a registered or pending trademark, which means the trademark application is where the decision gets made.
What Brand Registry actually gives you
- Control of the listing content, so a third-party seller cannot rewrite your product page.
- A route against counterfeiters and hijackers that works considerably faster than the general one.
- Enhanced content and store pages, which affect conversion.
- Access to brand analytics that are otherwise unavailable.
For a private-label seller these are not conveniences. Losing control of a listing you built is the most common way a profitable Amazon product stops being profitable.

Filing well
- Search before you file. A mark that conflicts with an existing registration wastes the fee and the months.
- File in the classes that match what you actually sell, and think about the adjacent categories you might expand into.
- Use a real specimen. Applications are refused for specimens that do not show the mark used in commerce on the goods.
- Expect months, not weeks. Brand Registry accepts pending applications in some circumstances, which is why filing early matters.
- Diarise the maintenance filings. A registration lapses if the required declarations are not filed, and losing it means losing Brand Registry with it.
The mark is what you are selling
When an aggregator or an individual buys an Amazon business, the diligence is about the brand, the listings, the reviews and the supply chain. A clean, properly owned trademark with an unbroken chain of title is the difference between a straightforward transaction and a discount.
